Collection of Personal Data

The Aude Department attaches the utmost importance to individual rights and freedoms.

The Departmental Council of Aude is committed to ensuring that the collection and processing of your data, carried out from the website forteressesroyalesdulanguedoc.fr, comply with the General Data Protection Regulation (GDPR) and the Data Protection Act.

In France, personal data is notably protected by Law No. 78-87 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article L. 226-13 of the Penal Code, and the European Directive of October 24, 1995.

The collection and retention of personal data are notably limited to what is strictly necessary to achieve the purposes and comply with the rights and obligations of the Department.

Any person entering personal information on this site acknowledges being of legal age. For minors, the digital age of consent is set at 15 years.

The legal bases for processing your personal data on this site are:

No transfer or disclosure of your data to third parties occurs.

Furthermore, the storage of this data in an active database and in intermediate archiving is time-limited.

The deletion date for data originating from forms is set at 12 months.

Data Subject Rights Management

I. Purpose of Data Processing

 

Purposes

The purpose of the processing is the management of data subject rights.

It allows the Department’s Data Protection Officer to manage requests:

– for information relating to personal data protection

– for the exercise of rights by data subjects concerning personal data

The processing is implemented by the Data Protection Officer.

 

Legal Basis

The processing is implemented to comply with a legal obligation (Article 6. 1. C) of the General Data Protection Regulation – GDPR.

The Department must be able to prove compliance with the GDPR, notably concerning the exercise of data subject rights in accordance with Articles 12 et seq. and 24 of the GDPR.

Documents justifying the exercise of rights:

– Applicant’s identity documents

– If the applicant is not the data subject:

– Identity documents of the applicant and the data subject

– Documents allowing the applicant to exercise the rights of the data subject on their behalf or in their place (parental authority, guardianship order…)

Data Source

The data is provided by the applicant.

Mandatory Nature of Data Collection

For the exercise of rights: all data is mandatory

For general information concerning the processing of personal data: Title, last name, first name, response address: email or postal

Automated Decision-Making

The processing does not involve automated decision-making or profiling.

 

III. Data Subjects

 

The data processing concerns any person who has formalized a request with the DPO within the scope of the purposes in Section I.

 

IV. Data Recipients

Categories of Recipients

The data is not transmitted to any other Department service or any other recipient. In accordance with current laws, it may be communicated to authorized third parties within the scope of their missions.

Data Transfers Outside the EU

No data transfer outside the European Union is carried out.

 

V. Data Retention Period

Data is retained for 3 months after the response provided by the Data Protection Officer or the Departmental service implementing the processing for which the rights were exercised.

The data is then anonymized for statistical processing.

 

VI. Security

Security measures are implemented in accordance with the Department’s Information Systems Security Policy (ISSP).

 

VII. Your Rights Regarding Your Data

You can access and obtain a copy of your data, object to its processing, or have it rectified or erased. You also have a right to restrict the processing of your data. Understand your rights on the CNIL website.
